Service details
U.S. citizens or permanent residents may sponsor their spouses if they meet the requirements. The type of petition depends on the sponsor's status and the marriage circumstances.
Key requirements
- Spouses of U.S. citizens may fall under IR1 or CR1; if the marriage is less than 2 years old at the time of receiving permanent residence, conditional permanent residence applies.
- Spouses of permanent residents fall under the F2A family preference category.
- It is necessary to prove a legal marriage, a bona fide relationship, and meet the financial sponsorship and U.S. residency requirements at the time of application.
Documents to prepare for initial assessment
- Proof of the sponsor's U.S. citizenship or green card.
- Marriage certificate; divorce or death certificates for previous marriages, if applicable.
- Evidence of the relationship and cohabitation; financial, tax, and residency records of the sponsor.
This list helps initiate the discussion; the official filing documents will be determined by the attorney based on the specific case.
Process
An attorney determines the eligibility of the relationship and the sponsorship category. Form I-130 is the step to establish the relationship; the immigrant visa application or adjustment of status is considered based on circumstances, visa category, and subsequent requirements.
Processing time depends on application review and visa availability; the attorney references the Visa Bulletin when necessary. There is no standard timeline that applies to all cases.
Important notes
IR1/CR1 and F2A petitions have different visa processing methods. Do not use the timeline of one category to promise results for the other.
How does KeyApply assist?
KeyApply receives your needs, organizes information, and coordinates discussions with U.S. immigration attorneys. The assigned attorney conducts the legal assessment, manages the case strategy, and provides representation according to a signed service agreement. After the assessment, you will have the scope of work and fees confirmed before deciding to proceed.
Service fees
Selecting “Register for Case Assessment” at 0 CAD is the initial request step, not the total price for an immigration petition. Professional consultation fees, processing fees, government fees, translation, medical examinations, and other incidental costs are confirmed separately; you pay according to the agreed-upon scope.
