EB-5 – US Investment and Immigration
EB-5 is intended for investors who contribute qualified capital to a commercial enterprise in the U.S. and meet job creation requirements. A spouse and unmarried children under 21 may be considered for inclusion; an attorney must evaluate the children's ages and the family's profile conditions separately.
Minimum Investment Amount
| Investment Amount | Scenario |
|---|---|
| 800,000 USD | Targeted Employment Area (TEA): rural or high unemployment; or qualified infrastructure projects. |
| 1,050,000 USD | Other investments under the standard rate. |
This is the investment capital and does not include project management fees, legal fees, government filing fees, translation, and related costs. The applicable capital level at the time of filing must be verified.
Key Requirements
- Demonstrate the lawful source of funds and the path of the money with appropriate documentation.
- Capital must be invested according to EB-5 requirements and be at risk; it is not a guaranteed savings deposit.
- Create at least 10 full-time jobs for qualified U.S. workers; specific regulations apply for preserving jobs in troubled businesses.
- Meet requirements regarding the enterprise, the investment, and individual immigration eligibility.
Direct Investment or Regional Center?
| Direct Investment | Individual investor files Form I-526. A business plan, management role, and qualified job creation must be assessed. |
|---|---|
| Regional Center | Investor files Form I-526E. The Regional Center must file Form I-956F for the investment offering before the investor files I-526E. |
The Regional Center program is currently authorized until 09/30/2027 by USCIS. The status of the Regional Center and project documentation must be checked before committing.
Process to Green Card
- U.S. attorney assesses the family, source of funds, and investment plan.
- Due diligence on project/business documentation, execution of investment, and preparation of I-526 or I-526E.
- After petition approval, proceed with consular processing for an immigrant visa or adjust status if eligible, depending on visa availability.
- Upon approval of adjustment of status or entry via EB-5 visa, the investor and dependents are granted 2-year conditional permanent residence.
- File Form I-829 within 90 days immediately preceding the 2-year anniversary of receiving conditional residence to petition for the removal of conditions.
Rural, Quota, and Processing Times
Visa set-asides include 20% for rural, 10% for high unemployment, and 2% for infrastructure. USCIS has a priority processing mechanism for rural petitions, but this does not guarantee processing times or perpetual visa availability. You must cross-reference the Visa Bulletin and USCIS guidance at each stage.
