Civil status registration does not resolve property rights

Recording a marriage/divorce updates civil status events according to authorized procedures; it does not automatically resolve disputes, divide property, or grant the right to sell real estate. It is necessary to verify the validity of foreign judgments/decisions, confirm the authority of the filing location, and provide translations and certifications as required by the documentation.

Canadian public documents within the scope of application may follow the Apostille process starting September 11, 2026, in lieu of consular legalization. Verify the type of document required before preparation: Embassy notice.

Marriage recording and Divorce recording are consular civil status procedures for Vietnamese citizens and/or individuals who have registered a marriage/divorce abroad and wish to have that marital or divorce event legally recognized under Vietnamese law.

💡 This is not a new marriage or divorce registration procedure, but rather the recording and transfer of information from abroad into Vietnam’s civil status registry to be recognized by Vietnamese law.

Service Content

  • Marriage recording
For cases where individuals have married at an authorized agency in Canada (or another country), then request the Embassy/Consulate General to record it in the Vietnamese civil status registry to determine marital status under Vietnamese law.

  • Divorce recording
For Vietnamese citizens who have divorced abroad and need to register that divorce in the Vietnamese civil status registry so that Vietnamese law officially recognizes their single status or to serve other procedures.

Who is this for?

  1. Vietnamese citizens residing or temporarily staying in Canada who have married/divorced in Canada or another country and want Vietnamese law to recognize that marriage/divorce event.
  2. Foreigners or dual citizens involved in a file that requires recording (according to applicable regulations).

Benefits of this service

  • Helps you officially recognize your marital/divorce status under Vietnamese law.
  • Supports domestic legal procedures such as: subsequent marriage registration, obtaining identification documents, immigration files, property procedures, proving single status, etc.
  • Ensures your file is updated in Vietnam’s Civil Status Database, avoiding potential legal disputes in the future.

Practical Q&A – Divorced in Canada, selling property in Vietnam

I married in Vietnam and divorced in Canada. Now that I want to sell a house in Vietnam, do I need a Certificate of Marital Status?

It cannot be determined solely based on information about a divorce in Canada. First, it is necessary to check the valid divorce judgment or decision, whether the foreign divorce has been recorded in the Vietnamese civil status registry, and the requirements of the agency handling the transaction in Vietnam. Depending on the case, it may be necessary to perform the divorce recording procedure, present documents proving marital status, and prepare translations/certifications of foreign documents as required. A Certificate of Marital Status does not automatically replace the divorce recording procedure when such a procedure is required.

In particular, it is necessary to determine whether the house is separate or marital property, the time the asset was created, the name on the ownership certificate, and the content of the property division agreement or judgment. A divorce does not automatically prove that an individual has the full right to sell the house. If there are interests of a former spouse or a co-owner, additional documents or the participation of relevant parties may be required.

KeyApply can conduct an initial discussion to identify the documents you need to prepare. For property ownership and real estate transactions in Vietnam, it is recommended to have a lawyer or authorized notary in Vietnam examine the specific file.
