Employer Nomination Scheme 186 – Employer Nominated Permanent Residence

A permanent residence visa for workers nominated by an Australian employer who meet the requirements of the relevant stream. Having a job offer is not enough to guarantee the grant of PR.

Three streams to distinguish

• Direct Entry: assessed directly based on occupation, skills, and experience requirements; it is not mandatory for all applicants to have held a 482 visa.
• Temporary Residence Transition: for those who meet the transition requirements from their visa status and appropriate work history.
• Labour Agreement: based on an employer's labour agreement and approved conditions.

Direct Entry: points to assess

Generally, one must be under 45 years old, have Competent English, at least 3 years of relevant experience, and a suitable skills assessment, unless exempt. The occupation, position, and employer nomination must also meet regulations.

Workflow

1. Verify the business, actual position, and suitable stream.
2. Assess the applicant's age, English proficiency, experience, skills, and current visa.
3. Prepare the employer nomination and visa application in the appropriate sequence.
4. Monitor additional requests and decisions from Home Affairs.

Do not consider the 482 visa a commitment to transition to the 186. The eligibility of the applicant, employer, and stream is assessed at the relevant time.
