AUTHORIZATION FOR USE IN VIETNAM: FROM SEPTEMBER 11, 2026, WHEN IS AN APOSTILLE REQUIRED?

📄 Are you currently in Canada but need to authorize a relative in Vietnam to handle real estate, banking, social insurance, inheritance, or civil matters?
Before signing any documents, it is essential to determine the correct type of procedure. Signature authentication, notarization, and Apostille are not a single, identical procedure.
📌 NEW REGULATIONS TO KNOW
Effective September 11, 2026, the Apostille Convention applies to Vietnam. Canadian public documents within the scope of the Convention can obtain an Apostille certification from the competent Canadian authorities and no longer require further legalization at the Vietnam Embassy.
An Apostille only verifies the signature, the capacity of the signatory, and the seal on the document; it does not verify the content or the legality of the transaction described in the document.
👥 WHO IS THIS SERVICE FOR?
This service is suitable for those in Canada who need to draft a power of attorney for someone in Vietnam to act on their behalf to:
- Handle procedures related to houses, land, or assets.
- Work with banks, social insurance agencies, or administrative offices.
- Submit, receive, or amend civil records.
- Handle inheritance files or renounce inheritance rights.
- Carry out specific tasks as required by receiving agencies in Vietnam.
📋 DOCUMENTS TO PREPARE
- Valid passport or government-issued ID of the grantor (the person giving authority).
- Full information of the grantee (the person receiving authority) in Vietnam.
- A draft document clearly stating the content, scope, and duration of the authorization.
- Proof of ownership or related rights if the file involves real estate, bank accounts, inheritance, or financial transactions.
- Templates or specific requirements from the notary office, bank, or agency receiving the documents in Vietnam.
- Proof of name change if the names on the Vietnamese and Canadian documents do not match.
🔎 SUPPORT PROCESS
1. Confirm the receiving agency
Clients should check in advance with the notary office, bank, or processing agency in Vietnam regarding the template, content, and format of the document they accept.
2. Submit documents for verification
Send a scan of your ID, the power of attorney draft, and related materials for KeyApply to check the required procedures.
3. Determine the correct processing path
Depending on the type of document, you may need to sign it in the presence of a consular officer or before a Notary Public in Canada before obtaining an Apostille.
For documents issued or notarized in Ontario, Official Documents Services is the competent authority for issuing Apostilles. Documents issued by the Government of Canada fall under the jurisdiction of Global Affairs Canada. Documents issued or notarized in other provinces must be sent to the corresponding competent authority.
4. Sign and notarize correctly
Do not sign in advance if the document requires signing in the presence of a Notary Public or consular officer. Real estate files require extra caution because a simple signature-authenticated power of attorney does not automatically replace a notarized power of attorney contract.
5. Obtain Apostille and complete translations
Qualified documents are sent to the competent Canadian authority. If the document is not in Vietnamese, a notarized or certified Vietnamese translation may be required according to applicable regulations.
⚠️ PRACTICAL NOTES
- Not all powers of attorney use the same template or follow the same process.
- The content must be confirmed by the receiving agency in Vietnam before signing.
- An Apostille does not guarantee that the notary office, bank, or agency in Vietnam will accept the transaction content.
- Some documents remain outside the scope of the Apostille, such as documents executed by diplomatic or consular officers, or administrative documents directly related to commerce or customs.
- Documents legalized before September 11, 2026, remain valid; they do not need to be redone due to the new regulations.
