"Can Canadian tourists use the 'flagpoling' method to apply for a Work Permit for the Start-Up Visa (SUV) program for the first time?"
This is a question we receive from people who are in Canada as tourists and are applying for the SUV program.
1. Regulations regarding Flagpoling
"Flagpoling" is an informal term in immigration, referring to an applicant leaving Canada, traveling to a U.S.-Canada border crossing, and then returning to apply for a work permit or similar documents. However, according to the Canada Border Services Agency (CBSA) website, travelers without prior work permit approval do not meet the requirements for flagpoling. For more information, please refer to CBSA - Settle in Canada .
2. How to apply for a Work Permit (WP) while traveling in Canada
2.1. Apply Online Under a Public Policy
The official website of the Government of Canada provides information on applying for a Work Permit through online submission under a temporary public policy. Normally, tourists cannot apply for a Work Permit while inside Canada. However, due to a temporary policy change, you can apply online for a work permit from your employer for a specific job. Details can be found at Apply for a work permit — Temporary workers .
2.2. Conditions of Application
- You must be in Canada when you apply.
- You must remain in Canada while your application is being processed.
- Applications must be submitted between August 24, 2020 and February 28, 2025.
- Valid residency status is required when applying.
2.3. Special Cases
Holders of the Certificat de sélection du Québec (CSQ) are also eligible for this temporary public policy.
2.4. Special Conditions for the SUV Program
In the case of the SUV program, the Work Permit (WP) will be a "closed work permit" for the specific company you intend to work for, even though you are exempt from the Labour Market Impact Assessment (LMIA). Therefore, you can still utilize public policy at this time.
3. Preparing for Flagpoling
Once you receive your WP approval letter and proceed with flagpoling, have all the necessary documents ready:
- Company profile and business plan.
- A thorough understanding of the company's operations and your role.
This is important because you may have to go through a rigorous interview with border officers.
In short
Applying for a Work Permit (WP) for the SUV program for the first time is not simply flagpoling; it also involves thorough preparation and a clear understanding of the application process and program requirements. In particular, if you choose the flagpoling method, ensure you are prepared for all possible scenarios at the border.
