If you are currently residing in Canada without status, are there any opportunities to apply for the Home Care Worker Immigration Pilot?
Typically, to participate in the Home Care Worker Immigration Pilots program (including Child Care and Home Support), applicants must have legal status and be permitted to work in Canada. However, IRCC has implemented a public policy that opens a special door for a small group of home care workers who no longer have legal status or work permits.
What does this public policy allow?
To be eligible, you need:
- Must be in Canada when applying;
- No work permit and currently: No temporary residence status, or only visitor status;
- Having legally entered Canada on or before December 16, 2021, and residing continuously since then;
- I previously held a work permit during this period of residence;
- Not denied entry to Canada for reasons other than overstaying, working/studying without permission, or having a relative who has committed a similar offense.
Who is ineligible?
- People who started living in Canada after December 16, 2021;
- A person who has never held a valid work permit during their current period of residence;
- The person who applied for asylum;
- The person is under a deportation order;
- People who are in Canada on a study permit.
Additional notes
When applying for permanent residency under this policy, you and your family can simultaneously apply to reinstate or extend your temporary residency status while your PR application is being processed.
Of course, in addition to the conditions mentioned above, you must still meet all other requirements of the Home Care Worker Immigration Pilots program: language proficiency (Club 4), education, caregiving experience, etc.
In summary: If you are residing in Canada without status, there is still a legal avenue to apply for the Home Care Worker Immigration Pilot thanks to a special public policy. However, only a small group of people qualify, and they must strictly meet the requirements regarding residency time, previous work permits, and the overall program standards.
