My child is almost past the age of dependence; what type of application should I submit in a timely and efficient manner?
Which programs can be applied to in time for your child to reach the age of dependence? First, let's learn about the age of dependence and the important milestone called the "age cutoff date".
What is your child's dependency age?
To qualify as a dependent child when applying for a temporary or permanent residency visa in Canada, your child must be within the age limit and meet the dependent child requirements.
The age limit for dependent children (for immigration purposes) has changed from “under 19 years old” to “under 22 years old”. This change applies to all new applications received on or after October 24, 2017.
To qualify as a dependent, children must:
- Under 22 years old
- No spouse or general partner
Note: A child's age will typically be "locked" once CIC receives the complete application.
Exception: Older children may qualify as "overaged" dependents if:
- Having relied on parents for financial support before they reached the legal age limit and
- Unable to provide for oneself financially due to mental or physical condition.
From which date is age "locked" calculated?
The file is complete.
The application is complete after you:
- Answer all the questions in the application form.
- Submit proof that you have paid the applicable fees for your application and
- Submit all necessary forms and documents.
If you forget to submit documents and/or forget to pay fees:
- Your application may be returned and you may not have completed the submission process.
- Your processing time may be delayed, or
- Your application may be rejected.
"Age-locking day"
Depending on the type of application submitted, the "age cutoff" date is specified as follows:
The "age cutoff" date is the date the application processing office receives a completed permanent residency application for the following programs:
- Sponsorship for family reunification
- Federal skilled worker
- Federal Skilled Trade
- Canadian Experience Class
- Start-up business
- Self-employed
- Humanitarian and compassionate
- Privately-sponsored refugee
- Home child care provider pilot and home support worker pilot
The "age limit" date for other programs:
- Atlantic Immigration Pilot: The date the province receives a complete "endorsement application".
- Provincial Nominee Program: The date the province or territory received your complete provincial nomination application.
- Refugee selected overseas: Date you received your referral letter from the refugee referral organization.
- Family members not accompanying the Protected Person (“One-Year Period”): The date of receipt of the completed permanent residency application from the principal applicant granted asylum overseas. (Must be within one year of the date the principal applicant was granted Protected Person status.)
- Asylum seekers in Canada: The date the CIC or Canada Border Services Agency receives a complete asylum application.
- Quebec Skilled worker, Immigrant investor, Entrepreneur, Self-employed, Quebec Distressful Situations: Date Quebec receives application for Certificat de sélection du Quebec (Quebec Selection Certificate).
- Quebec Collective Refugee Sponsorship Association: Date Quebec Receives Complete Commitment Application from Sponsor.
