Federal Court Indefinitely Blocks Trump's Executive Order Revoking Birthright Citizenship
On January 20, 2025, President Donald Trump signed Executive Order 14160 to end birthright citizenship for children born in the United States to parents who are not citizens or lawful permanent residents. This order is scheduled to take effect on February 19, 2025.
However, the executive order has faced numerous legal challenges. On January 23, 2025, Judge John C. Coughenour of the Western District of Washington temporarily blocked its enforcement, calling it "clearly unconstitutional." Subsequently, on February 5, 2025, Judge Deborah Boardman of the Maryland District Court issued a nationwide preliminary injunction, preventing the order from taking effect indefinitely while lawsuits are being resolved.
Judges argued that the order violated the 14th Amendment to the U.S. Constitution, which stipulates that all persons born on American soil and subject to the "rule of law" of the United States are U.S. citizens. Lawsuits against the order were filed by immigrant rights groups and several Democratic-led states, arguing that the order could strip more than 150,000 children born each year of their citizenship.
The U.S. Department of Justice has appealed these decisions, and the cases are expected to go to the Supreme Court for review. Currently, the executive order remains blocked and has not yet taken effect.
