Important update from IRCC regarding the Startup Visa Program.
Immigration, Refugees and Citizenship Canada (IRCC) has announced significant changes to its guidance for visa officers assessing work permit applications under the Start-Up Visa Program, with LMIA waiver code A-77.
Applications received from May 18, 2023 onwards will be considered based on the new criteria.
For applications received before May 18, 2023, immigration officers may request any necessary documents not previously provided to conduct a full assessment in accordance with these new guidelines.
According to the new regulations, applicants for a Start-Up Visa Work Permit must demonstrate that they have sufficient funds to operate their business as planned.
One point of ambiguity in the new guidance is whether a "Significant C-10 Benefit" check is required under the new A-77 conditions. The reason this might be required is because the new guidance states:
"If the officer is dissatisfied that the criteria for the work situation described by management code A77 are met or that the applicant's work will generate or sustain a substantial economic, cultural, or social benefit, and there is no specific reason for refusal in the GCMS, they should select the reason for refusal "Other" and add a brief explanation in the Comments field that they are dissatisfied with R200 or paragraph R205(a) ."
"Significant Benefit" is a key concept in Canadian immigration policy. It's an exemption from the Labour Market Ineligibility Assessment (LMIA) requirement that Canada applies to certain foreigners who wish to work in Canada. To qualify for an LMIA exemption under the "Significant Benefit" criterion, a foreigner must demonstrate that their work in Canada will provide significant benefits to the country.
These benefits may include job creation, skill and knowledge transfer, or contributions to cultural or academic fields. It is crucial that the individual demonstrates that the benefits they provide will exceed what a Canadian citizen or permanent resident could offer in a similar situation. This is not a simple criterion to meet, especially for those holding a Starter Visa.
With the application of the C-10 criteria to the Entrepreneur Visa Program, the visa application process may become more complex, requiring specialized skills, knowledge of the Canadian labor market, and careful preparation of documents.

What if the Start-Up Visa Work Permit program started applying the "Significant Benefit" criterion under the C-10 form?
Holders of this work visa will need to demonstrate that the work they perform will provide significant benefits to Canada. Here are some ways they can do this:
