IRCC has agreed to pay $65,000 to a permanent resident whose citizenship application has been pending for over 20 years.
Mahmoud Sharafaldin is an Iranian citizen. In 1995, the Refugee Identification Unit of the Canadian Immigration and Refugee Board (“IRB”) accepted his refugee protection request. He became a permanent resident of Canada in 1996.
On December 23, 1999, Mr. Sharafaldin applied for Canadian citizenship. More than twenty years later, his application is still pending.
Mr. Sharafaldin filed a petition for retrial under section 22.1 of the Nationality Act, RSC 1985, c C-29.
The court concluded that the Minister was responsible for making a decision on Mr. Sharafaldin's application for Canadian citizenship, that he had taken an unreasonable amount of time, and that a decision should have been made without excessive delay.
On July 6, 2022, the court ruled that the total cost to be awarded to the applicant was $65,000.
