What is the difference between RISIA, RCIC, and other lawyers?

Many people use the terms RCIC (Regulated Canadian Immigration Consultant), RISIA (Regulated International Student Immigration Advisor), and immigration lawyer interchangeably to project a more professional image or attract clients. However, the differences between these three groups are significant, and when handling complex immigration programs like the Start-Up Visa (SUV) , having only an RCIC or immigration lawyer is insufficient.

Who is taller, RISIA or RCIC?

RISIA (Regulated International Student Immigration Advisor) and RCIC (Regulated Canadian Immigration Consultant) have very different scopes of service:

1. RISIA (Regulated International Student Immigration Advisor)

  • Scope of activities: Only authorized to provide advice on matters related to international students , such as study permits, post-graduation work permits (PGWP), and the rights of international students on campus.
  • Limitations: We do not provide advice on immigration in general (e.g., permanent residency, settlement programs, or family sponsorship).
  • Licensed by: Universities, colleges, or educational institutions where they work, under the management of the former Immigration Consultants of Canada Regulatory Council (ICCRC), now CICC (College of Immigration and Citizenship Consultants).
  • Work environment: Primarily working in international student support offices at schools.

2. RCIC (Regulated Canadian Immigration Consultant)

  • Scope of practice: Authorized to provide advice on all matters related to Canadian immigration , including:
    • Immigration programs (Start-Up Visa, Express Entry, Provincial Nominee Program, etc.).
    • Permanent residency, citizenship, family sponsorship.
    • Types of work permits, study permits, and tourist visas.
  • Licensed by: CICC (College of Immigration and Citizenship Consultants).
  • Requirements: Must pass the licensing exam, meet training and practical requirements, and adhere to strict professional ethics regulations.

The vast differences between RISIA and RCIC

RISIA is more like an "academic advisor" that only supports international students within the school, while RCIC is a comprehensive immigration specialist that can handle everything from visas to permanent residency. If you need advice on studying in Canada , you can contact RISIA. But if you need assistance with applying for PR, permanent residency, or other immigration issues , RCIC is the competent authority to help you.

The training period for RISIA and RCIC is shorter compared to other highly specialized professions, so not everyone with this title is capable of doing the job well. To assess whether an immigration specialist is truly competent, you cannot rely solely on the title; you need to consider many other factors such as professional competence, practical experience, and additional certifications.

The main difference between RCIC and immigration lawyers.

Both RCICs (Regulated Canadian Immigration Consultants) and immigration lawyers can advise and represent clients on matters related to Canadian immigration, but there are significant differences in their authority, training, and scope of practice.

RCIC (Regulated Canadian Immigration Consultant)

🔹 Specializing in processing various types of immigration applications, including:

  • Immigrate to Canada through Express Entry, PNP, or Start-Up Visa.
  • Work permit (LMIA), study permit.
  • Family sponsorship, permanent residency (PR), and naturalization applications.

🔹 Can work directly with:

  • IRCC (Immigration, Refugees and Citizenship Canada) – Canadian Immigration Department.
  • CBSA (Canada Border Services Agency) – Canada's border management agency.
  • ESDC (Employment and Social Development Canada) – Ministry of Labour and Social Development.

🔹 Limitations of RCIC :

  • Unable to represent clients in court (Federal Court, Supreme Court).
  • It is not possible to process asylum applications or appeals at the IAD (Immigration Appeal Division).
  • It is not possible to process a case involving complex legal disputes.

Immigration Lawyer

🔹 As an immigration lawyer, you can handle all of RCIC's work but with additional authority:

  • Client representation in federal court.
  • Handling immigration appeals and litigation.
  • Protecting clients in complex situations such as visa denials, deportation, and orders to leave Canada.
  • Asylum application.

🔹 Usually works at:

  • Companies specializing in immigration.
  • Individuals practicing law.
  • Non-profit organizations help immigrants and refugees.

🔹 Advantages of hiring an immigration lawyer:

  • We have the ability to appeal, litigate, and protect clients' rights in court.
  • A deep understanding of the law enables one to handle complex or rejected cases.

🔹 Disadvantages of being an immigration lawyer:

  • The cost is higher than RCIC due to the level of expertise and litigation capabilities.
  • Not all lawyers specialize in immigration (it's important to find the right immigration lawyer).

When should you choose RCIC and when should you choose an immigration lawyer?

Choose RCIC if:

✔️ You need assistance with common visa applications such as Express Entry, PNP, Work Permit, and Study Permit.
✔️ You do not have any complex legal issues or disputes with IRCC.
✔️ You want to save money, because RCIC is often cheaper than a lawyer.

Choose an immigration lawyer if:

✔️ You need to appeal or litigate in court.
✔️ You've been denied a visa/PR and need a strong legal strategy.
✔️ You are at risk of deportation, have issues with your criminal record, asylum, or a complicated case file.

Both RCIC and immigration lawyers play important but irreplaceable roles. If you only need to handle a standard immigration application, RCIC is a suitable and cost-effective option. However, if your application involves complex legal elements or requires an appeal, an immigration lawyer has the authority to assist you.

Why isn't having just RCIC or an immigration lawyer enough for the Start-Up Visa program?

The Start-Up Visa (SUV) program is not just a simple immigration program, but also a technology and finance-related startup program, so having only an RCIC or immigration lawyer is not enough . The SUV requires a multidisciplinary team of experts .

Many RCICs and even lawyers handle SUVs but lack sufficient expert teams, resulting in weak applications that are easily rejected.
