EB-5: No need for the full $800,000 upfront? Explore installment payment options
Investors interested in the U.S. EB-5 program often ask: is it necessary to have the full $800,000 ready before starting?
According to information provided by EB5 Energy Fund I, the fund may consider partial capital contribution plans based on individual agreements. This does not mean that every investor is automatically eligible to file an application upon making a partial payment.

Partial payment plan
- Initial payment: The amount and schedule for the remaining balance are agreed upon individually via a side letter with the fund.
- Form I-526E: The fund indicates the possibility of filing after receiving the initial payment. EB-5 attorneys must evaluate the capital commitment, source of funds, and USCIS requirements before proceeding.
- Full capital contribution: The remaining balance is paid on time according to the signed agreement.
What if the investment is not completed?
The fund states that there is a mechanism for refunding contributed capital, after deducting administrative fees, in certain cases. The feasibility, timeline, and conditions for a refund must be verified directly in the offering documents and side letter; this should not be viewed as a guaranteed capital return commitment.
EB5 Energy Oil and Gas Project
The fund presents an oil and gas project in a rural area of the U.S., featuring a fund equity ownership structure and a plan to operate eight oil wells. Information regarding mineral rights, permits, sales contracts, and I-956F approval status should be cross-referenced with updated project records before investing.
Note: EB-5 is an investment with the risk of capital loss. The $800,000 threshold applies when the project and investor meet legal requirements; not all EB-5 applications qualify for this rate. Filing Form I-526E does not guarantee approval or the issuance of a green card.
