A74 – Open Work Permit while being sponsored by a spouse/partner
Intended for certain applicants who are being sponsored as a spouse, common-law partner, or conjugal partner and are residing with their sponsor in Canada.
Eligibility and key requirements
- PR application must be received and meet policy requirements.
- Must hold temporary resident status, maintained status, or be eligible for restoration depending on the case.
- Verification of cohabitation with the sponsor and evidence of the relationship.
Documents to prepare
AOR or evidence per applicable exceptions, sponsorship application, shared address, residential status, and passport.
Key points to note
Marriage or submitting a sponsorship application does not automatically grant the right to work. Accompanying children who meet eligibility requirements may also be considered; those lacking status under the spousal public policy must wait for AIP.
LMIA exemption does not waive the requirement to meet work permit issuance conditions. Work permit and permanent residency applications are assessed separately.
