Simple divorce, also known as uncontested divorce, is when you and your ex-partner agree to divorce.

This is different from an amicable divorce, which is when you and your ex-partner disagree on all the issues that the divorce settlement raises. This could include disagreements about child custody or alimony, or how you will divide your assets.

With a simplified divorce process, there is an option to file for divorce online and avoid going to court.

Before we begin

  • Do you have your original marriage certificate? If not, and you were married in Ontario , you can order one online . If you were married outside of Ontario, you will need to obtain a marriage certificate from the government that issued your marriage certificate.
  • Do you need a translation of your marriage certificate? If your marriage certificate is not in English or French, you may need a certified translation. In Ontario, translators must be certified by the Canadian Council for Translation and Interpretation and must be members of the Ontario Association of Translators and Interpreters .
  • Have you been separated for at least a year?
  • Have you (or your ex) primarily lived in Ontario for at least a year?

    When can you get a divorce?

    When you receive your divorce decree by mail, your divorce takes effect 31 days after the judge signs the divorce papers.

    Then, you can return to the High Court of Justice and request the original copy of your marriage certificate and/or divorce certificate. The fee for a divorce certificate is $24 . You will need this divorce certificate if you wish to remarry.

    Service fees are in CAD and include notarization fees. This fee excludes :

    • The court filing fee is $699 . Court fees are tax-exempt.
    • The fee for obtaining a witness testimony at a divorce court is $24.
    • ATIO translation fees apply if necessary.

    Can I use this invoice for tax purposes?

    KeyApply's service fees are all tax-declarable.

    Does this service handle divorces in other provinces?

    Currently, the service only handles divorces in Ontario courts.

    We are not Canadian citizens, nor were we married in Ontario, so can we get a divorce in Ontario?

    You may be granted a divorce in Ontario regardless of where the marriage took place or the nationality of the individuals involved. However, you may be required to demonstrate that you (or your ex) have primarily lived in Ontario for at least one year.

    You can file for and be granted a divorce as long as you and your spouse are legally married in Canada or another country.

    If I don't know my ex's whereabouts, can I still get a divorce?

    You can still file for divorce. However, you must first make every effort to locate your ex. If you are unable to locate them, you can apply to the judge for an injunction, which is a court order outlining what you must do to ensure your spouse is aware of the divorce filing. Before the judge grants you a divorce, they must know that you have made every effort to locate your ex. If you have made every effort but still cannot locate them, the divorce may still be granted.
