R02 – H-1B Open Work Permit renewal granted for less than 3 years

R02 – Extension of H-1B Open Work Permit issued for less than 3 years

Service for individuals who were granted an OWP under the H-1B policy but whose validity was shortened due to passport or biometrics expiration.

Key eligibility and conditions

• Currently residing in Canada when submitting the extension application.
• Holding an H-1B OWP under the original/supplementary qualifying policy.
• Initial permit was for less than 3 years due to passport/biometrics; applying for the remaining duration.
• Submit extension under the policy no later than December 16, 2026; family members are assessed based on their own eligibility.

Required documents

Current permit, new passport, biometrics, and evidence that the initial permit was restricted.

Important notes

The policy for new H-1B applicants closed on July 17, 2023. This is an extension of the remaining portion of the 3-year maximum, not a new 3-year cycle.

LMIA exemption still requires meeting work permit eligibility criteria. Work permits and permanent residency are assessed separately.
