U.S. citizens aged 21 and older may file a petition to sponsor their parents for U.S. permanent residency. Permanent residents do not yet have the right to sponsor parents under this category.

Key Requirements

  • The sponsor must be a U.S. citizen and at least 21 years old.
  • Must prove a qualifying parent-child relationship; specific regulations apply to stepparents, stepchildren, or adoptions.
  • A separate Form I-130 is typically required for each beneficiary.

Documents to prepare for initial assessment

  • The sponsor's birth certificate and proof of U.S. citizenship.
  • The parents' identity documents; marriage certificates and relevant family records.
  • Financial, tax, and residency information for attorney review regarding financial sponsorship.

This list serves as a starting point; the official filing requirements will be determined by an attorney based on your specific case.

Process

An attorney will determine the qualifying relationship and sponsorship category. Form I-130 is the step to establish the relationship; the application for an immigrant visa or adjustment of status is considered based on individual circumstances, visa category, and subsequent requirements.

Processing times depend on case review and visa availability; the attorney will consult the Visa Bulletin as needed. There is no standard timeline that applies to all cases.

Important Notes

Sponsoring parents does not automatically include their other children. Each family member's case must be assessed individually.

How does KeyApply assist?

KeyApply receives your request, organizes your information, and coordinates consultations with U.S. immigration attorneys. The assigned attorney handles the legal assessment, case strategy, and representation as defined in the service agreement. Following the assessment, you will receive a confirmation of the scope of work and a fee quote before deciding to proceed.

Service Fees

Selecting “Register for Case Assessment” at 0 CAD is the initial request step and is not the comprehensive fee for the immigration application. Professional consulting fees, processing fees, government fees, translation costs, medical examinations, and incidental expenses are confirmed separately; you will pay based on the agreed-upon scope of work.
