EB-2 is for professionals with advanced degrees or individuals with exceptional ability in the sciences, arts, or business.
Key Requirements
- Advanced Degree Category: An appropriate postgraduate degree or a bachelor's degree plus at least 5 years of progressive professional experience after graduation.
- Exceptional Ability Category: Evidence of a degree of expertise significantly above that ordinarily encountered in the field.
- Under the standard route, a job offer and a U.S. employer sponsor are required; labor certification is generally necessary. NIW is a specific waiver request that is considered separately.
Documents to prepare for initial evaluation
- Degrees, transcripts, and CV.
- Employment verification letters detailing duration, duties, and professional growth.
- Job offer, position requirements, and employer information; evidence of ability if applying under that category.
This list is a starting point for discussion; the formal application documents will be determined by an attorney based on the specific case.
Process
An attorney determines the appropriate category, evaluates the applicant, and assesses the need for labor certification. Following the petition stage, the application for an immigrant visa or adjustment of status is processed based on the candidate's individual circumstances and visa availability.
Processing times depend on application reviews and visa status; the attorney refers to the Visa Bulletin when necessary. There is no standard timeline applicable to all cases.
Important Notes
Having a master's degree does not guarantee EB-2 eligibility: both the position requirements and the candidate's credentials must be evaluated.
How does KeyApply assist?
KeyApply receives your inquiry, organizes information, and coordinates consultations with U.S. immigration attorneys. The assigned attorney handles legal evaluations, case strategy, and representation as per the agreed service contract. After the initial assessment, you will receive a confirmation of the scope of work and a fee quote before deciding to proceed.
Service Fees
The "Register for Case Evaluation" option at 0 CAD is the initial request step, not the full fee for the immigration application. Professional consultation fees, processing fees, government filing fees, translations, medical exams, and incidental costs are confirmed separately; you pay according to the agreed-upon scope of work.
