Stay of Removal
This is an emergency procedure requesting the Federal Court of Canada to temporarily halt the enforcement of a removal order while another legal proceeding is being resolved. Being granted a stay does not mean that the removal order has been canceled.
What does the Court consider?
A stay request is generally evaluated based on three main factors:
- There is a serious issue to be considered by the Court;
- If the stay is not granted, the applicant may suffer irreparable harm;
- The balance of convenience favors the granting of the stay.
This is typically a time-sensitive procedure. The file may require affidavits, evidence, and written arguments. The outcome depends on the specific circumstances of each case.
